Patent Protection Period:   10, 15 or 20 years, as per the applicant's request.

 

Annuity Payments: Required one year upon the filing date, and can be paid any time before due date. Late settlement of annuities can be done upon payment of lateness fine.

 

From Filing to Grant:          7-8 months

 

Convention Priority:         Yes

 

Novelty:                          Required   

 

Filing Language:               English or French, and should be translated into Persian.

 

PCT:                                Iran is not contracting state of PCT

 

Procedure:  Once the patent application is filed, it is queued to be examined by the Iranian Patent Office with respect to compliance with formalities only. Accepted applications will become granted patents. Upon grant, the patent is published in the Official Gazette. Any interested party may file an opposition against the patent within thirty days as of publication before the First Instance Public Court.

 

Requirements

 

Filing Requirements for Patent Application:

1- Power of Attorney, duly legalized up to the Consulate of Iran.

2- Three copies of the specification, claims and abstract (in French or English).

3- Four sets of the formal drawings, (if any).

4- Certified copy priority document along with its translation into English, if priority rights are to be claimed.

5- For patent of importation, a certified copy of the letters patent *

 

* Patent of importation is based on a foreign or PCT granted patent and is valid for the remaining life of the foreign patent.

 

Requirements for Assignment Applications

1- Power of Attorney by the Assignee, legalized up to the Consulate of Iran.

2- Deed of Assignment, notarized and legalized up to the Consulate of Iran.

3- The original Letters Patent for endorsement.

 

Requirements for Change of Name/Address:

1- Power of Attorney in the new name/address, legalized up to the Consulate of Iran.

2- Certificate proving the change of name/address, duly legalized up to the Consulate of Iran.

3- The original Letters Patent for endorsement.

 

Requirements for License Agreement:

1- License Agreement signed by both parties, notarized and legalized by the consulate of Iran.

2- Power of attorney from the Licenser and Licensee, notarized and legalized up to the Consulate of Iran.

3- Valid Iranian Letters Patent or renewal certificate for endorsement.
