Annuity Payments: Annuities are to be paid every year on the anniversary date of completing the relevant file at the Patent Office with the required documents. However, payment of annuities may not be made to the Patent Office except after the grant of the patent with retroactive effect.

 

Procedure: Once the patent application is filed, it is queued to be closely examined by Iraqi Patent Office with respect to compliance with formalities and patentability provided for in the Patent Law. The Registrar may request information and documentation for undertaking the technical examination. Upon acceptance, the application will be published in the Official Gazette. In absence of any opposition, the letters patent is issued.

 

Requirements

 

Filing Requirements for Patent Application

1- Eight copies of abstract, specifications, claims and drawings.

2- Power of Attorney, duly legalized up to the Consulate of Iraq. Legalization stamp should be overleaf the Power of Attorney sheet itself. The Power of Attorney should include Israel Boycott Declaration (form available on request).

3- Certified copy of the priority document duly legalized up to the Consulate of Iraq, in case priority is to be claimed.

4- Assignment deed from the inventor(s), duly legalized up to the Consulate of Iraq, in case the applicant is not the inventor.

 

* Documents in item (1) should be submitted to the patent office with the application, while documents in items (2, 3 and 4) can be submitted upon filing the patent application.

 

* The Registrar of patents may ask for a legalized copy of the corresponding foreign basic letters patent and/or a novelty search report.

 

Requirements for Assignment Applications

1- Power of Attorney, duly legalized up to the Consulate of Iraq. Legalization stamp should be overleaf the Power of Attorney sheet itself. The Power of Attorney should include Israel Boycott Declaration (form available on request).

2- Deed of Assignment, signed by both parties, notarized and legalized up to the Consulate of Iraq.

 

Requirements for Change of Name/Address:

1- Power of Attorney, duly legalized up to the Consulate of Iraq. Legalization stamp should be overleaf the Power of Attorney sheet itself. The Power of Attorney should include Israel Boycott Declaration (form available on request).

2- Certificate proving the change of name/address issued by the local competent authority in the applicant's domicile, duly legalized up to the Consulate of the Iraq.
