Annuity Payments: Required upon issuance of Letters Patent starting from the filing or priority date. Late settlement is possible within 6 months as of the annual due date, and fees in this case are doubled.
Novelty: Required. The disclosure of the invention to the public shall not be taken into account if it occurred twelve months before the filing date of the application or before its priority date.
Filing Language: Specifications, claims, abstract, drawings and related documents should be translated into Arabic if they are in English, and into English and Arabic if they are in a third language.
Procedure: Once the patent application is filed, it is queued to be examined by Jordanian Patent Office with respect to compliance with formalities. If accepted, the applicant is notified to settle the substantive examination fees. Upon settlement, the application is forwarded to substantive examination. The examiner may request amendments to the application. When the application meets all requirements stipulated in the Law and the terms of granting the patent, and upon settlement the publication fees, a decision of preliminary acceptance is issued and published in the Official Gazette. In absence of any opposition within 3 months as of the publication date, the Registrar shall issue his decision granting the patent after the payment of the due fees.
Requirements
Filing Requirements for Patent Application:
1- Three copies of specification, claims and drawings (if any)
2- Applicant’s full name and address
3- Inventor(s)’ full name(s) and address(s)
4- Power of Attorney, duly notarized and legalized up to the Consulate of Jordan.
5- Certified copy of the certificate of registration of the company or articles of association for a corporate person.
6- A deceleration supplemented by Oath signed by the inventor(s) and legalized up to the Consulate of Jordan
7- Deed of Assignment executed by the inventor(s), duly notarized and legalized up to Consulate of Jordan.
8- Certified copy of the priority document (if priority is to be claimed). This document may be filed within 60 days from the filing date, provided that the filing date and number are available upon filing the application
9- For publication in the official gazette, a brief description (200 words) of the invention and claims is needed. It should be independent of the application and
including the following:
* The inventor(s)' and the applicant’s name and addresses.
* A summary of the specifications and claims and any illustrative drawing related. The said summary must indicate the technical or scientific field of the invention and give a clear idea of the technical problem, the essence of its solution and the main uses of the Invention
* The chemical formula that best distinguishes the invention compared with the other formulas listed in the application if needed and if the invention is a chemical one.
* The best suited illustrative drawing among those presented by the applicant (if applicable).
Requirements for Assignment Applications
1-Power of Attorney by the Assignee, duly legalized up to the Consulate of Jordan
2- Deed of Assignment, signed by both parties, notarized and legalized up to the Consulate Jordan.
3- Name, address, nationality and profession or nature of business of the Assignee
Requirements for Change of Name/Address:
1- Power of Attorney in the new name/address, duly legalized up to the Consulate of Jordan.
2- Certificate proving the change of name/address, duly legalized up to the Consulate of Jordan.
Requirements for License/Registered User Agreements:
1- Power of attorney, duly legalized up the Consulate of Jordan
2- License Agreement executed by both parties, duly legalized up to the Consulate of Jordan.
