Bahrain: TM Procedure Bahrain: TM Requirements

 

From Filing to Registration: Approximately 24 Months

Convention Priority:           N/A

Classification of Goods/Service: International (8th edition)

Multiple Class Applications: N/A

 

Registration Validity: 10 years, renewable for other consecutive periods, each of which is 10 years.

 

Renewal Time: Application for Renewal should be submitted prior to expiry date. Late renewal can also submitted within three months as of the termination of the protection period.

 

Trade/Service mark Use: Not pre-requisite for registration. However, a trademark is vulnerable for cancellation by any interested party, who may prove that the trademark

was not actually used during the five years preceding the application for cancellation.

 

Procedure: Once the application is filed, it is queued to be examined as to trademark registrability. Accepted applications by the Registrar are published in the Official Gazette. There are 60 days period open for filing an opposition by any interested party. In the absence of an opposition, the published trademark is registered, and the certificate of registration is issued.

 

Requirements:

 

 Trademark/Service Mark Applications

1- Power of attorney, simply signed and stamped with the corporate seal.

2- A certified copy of the home registration or any foreign registration of the trademark.

3- Applicant's details (name, address, nationality, etc.).

4- Eight prints of the mark, if it is a device mark.

 

Renewal of Trademark/Service Mark Registrations

1- Power of attorney, simply signed and stamped with the corporate seal.

2- Photo copy of the certificate or registration

 

Assignment Applications

1- Power of attorney, simply signed and stamped with the corporate seal of the Assignee.

2- Deed of Assignment, signed by both parties and legalized up to the Consulate of Bahrain.

 

Change of Name/Address Applications

1- Power of attorney in the new name, simply signed and stamped with the corporate seal.

2- A letter from the mark proprietors addressed to the Trademark Registrar in Bahrain requesting to effect the change of name or address.

 

Registered User Applications

1- Power of attorney by the registered user, simply signed and stamped with the corporate seal.

2- Power of attorney by the registered original owner of the trademark, simply signed and stamped with the corporate seal.

 

3- A license agreement or a registered user agreement, duly legalized.

 

Amendment Applications

1- A letter from the mark proprietors addressed to the Trademark Registrar in Bahrain requesting to effect the required amendment.

2- Seven prints of the amended trademark/service

mark.

 

Agency Agreement

1- Power of attorney, duly legalized up to the Consulate of Bahrain.

2- An Agency Agreement executed by the Principal and the Agent, legalized up to the Consulate of Bahrain.
